EFESC Permitting Review Process

The proposed terminal is currently undergoing Washington’s robust permitting review process. We are committed to the most thorough, transparent and comprehensive permitting process for Vancouver Energy: Washington’s state-run Energy Facility Site Evaluation Council (EFSEC) process. EFSEC is looking at multiple aspects of the proposed terminal and includes a detailed environmental impact statement. The terminal is being reviewed against local, state and federal requirements that protect human health, wildlife and the environment.

We are confident EFSEC’s findings will confirm the proposed terminal can be designed, constructed and operated in a safe and environmentally-responsible manner. The below timeline summarizes key points in times for the permitting review process thus far. A timeline from the Port of Vancouver USA is also available here.

  • January 2012: Port of Vancouver USA elects to seek crude oil terminal.
  • November 2012: Port of Vancouver USA invites qualified companies to submit proposals.
  • April 2013: Port of Vancouver USA selects Vancouver Energy to pursue permit.
  • May 2013: Port of Vancouver USA begins hosting public workshops on Vancouver Energy.
  • June 2013: Port of Vancouver USA hosts additional public workshops to provide information to the commission and public (June 12, June 27, June 27).
  • July 22, 2013: Port of Vancouver USA continues to host workshops to provide further information to its commission and public.
  • July 23, 2013: Port of Vancouver USA announces its Board of Commissioners unanimously approved a 10-year lease with Vancouver Energy for a crude oil handling facility at the Port of Vancouver USA.
  • August 29, 2013: Vancouver Energy submits its project application to Washington’s Energy Facility Site Evaluation Council (EFSEC).
  • October 2013: Port of Vancouver USA reapproves Vancouver Energy’s lease.
  • October 3 – December 18, 2013: EFSEC holds a public comment period for Vancouver Energy’s application.
  • April 2, 2014: EFSEC approves the scope of the Environmental Impact Statement (EIS) related to Vancouver Energy.
  • August 2014: Vancouver Energy submits a Preliminary Draft Environmental Impact Statement (PDEIS).
  • August 2014: EFSEC issues a land use order, confirming the proposed use by Vancouver Energy is consistent with local land use plans and ordinance.
  • August 2014: EFSEC extends application completion date to March 2, 2015.
  • January 2015: Adjudication phase commences.
  • February 2015: EFSEC extends application completion date to November 1, 2015.
  • May 2015: EFSEC sets the deadline for adjudication submissions.
  • June 22, 2015: EFSEC releases its delayed schedule for Vancouver Energy’s Draft Environment Impact Statement (DEIS).
  • July 7, 2015: Notification that the U.S. Army Corps of Engineers (Corps) and EFSEC will conduct a review of Vancouver Energy in accordance with the Clean Water Act is released.
  • October 2015: EFSEC extends application completion date to May 1, 2016. Vancouver Energy agrees to extend public comment period for DEIS.
  • November 24, 2015: EFSEC releases the DEIS.
  • November 2015 – January 2016: EFSEC opens public comment period on the DEIS.
  • January 22, 2016: Vancouver Energy submits its official comment letterto EFSEC.
  • April 2016: EFSEC extends application completion date to November 1, 2016.
  • June 27 – July 29, 2016: EFSEC conducts the adjudicative hearings related to the DEIS.
  • August 2, 2016: EFSEC concludes the final adjudicative hearing.
  • August 2016 – Present: EFSEC is preparing the final EIS with a recommendation to Governor Jay Inslee on whether or not to approve the terminal.
  • October 2016: EFSEC extends application completion date to March 1, 2017.
  • November 29, 2016: National Pollutant Discharge Elimination System (NPDES) Construction Stormwater Permit public comment period is closed.
  • February 2017: EFSEC extends application completion date to June 30, 2017.
  • June 7, 2017: Notice of Construction (NOC) Air Permit public comment period is closed.
  • June 2017: EFSEC extends application completion date to August 31, 2017.
  • August 2017: EFSEC extends application completion date to November 30, 2017.
  • August 22, 2017: NPDES Industrial Stormwater Permit public comment period is closed.
